The petition was filed by Sandeep Kumar Gupta, whose brother Deepak Kumar Gupta was serving as an Ordinary Seaman aboard the cargo vessel MV AGN Ragnar.
On 25 July 2026, the vessel reportedly came under a drone attack in the Black Sea near Ukraine, triggering a fire and forcing crew members to abandon the ship under life-threatening circumstances.
The vessel carried nine crew members, including four Indian nationals.
Soon after the incident, conflicting reports emerged regarding the fate of the crew:
- Initial reports suggested that all four missing crew members had drowned.
- Other reports indicated that two missing seafarers had actually been rescued and were in the custody of Romanian authorities.
- Official confirmation regarding the whereabouts of two Indian nationals, including Deepak Kumar Gupta, remained unavailable.
This uncertainty prompted the family to approach the Supreme Court seeking immediate intervention.
Proceedings Before the Supreme Court
The matter came before a Bench comprising:
- Chief Justice of India Surya Kant
- Justice Joymalya Bagchi
- Justice V. Mohana
During the hearing, the Bench expressed serious concern over the contradictory reports surrounding the missing Indian seafarers.
The Chief Justice observed that the matter required immediate diplomatic intervention, noting that conflicting information from different sources had created uncertainty about whether the missing crew members had survived the attack.

- Indian Embassy in Ukraine,

Petitioner’s Submissions
Counsel appearing for the petitioner informed the Court that:
- Two Indian crew members had reportedly been rescued with the assistance of the Romanian Coast Guard.
- The remaining two crew members were forced to jump into the sea while escaping the fire caused by the drone attack.
- Certain media reports suggesting the rescue of two Indians were later withdrawn, creating confusion.
- International reports continued to indicate that the rescued individuals could possibly be the missing Indian seafarers.
- Despite these reports, there had been no official confirmation, no communication, and no consular access to the missing Indians.
The petitioner also raised apprehensions regarding the possibility of human trafficking, considering the geopolitical instability prevailing in the region.
Observations Made by Justice Joymalya Bagchi
Justice Joymalya Bagchi referred to correspondence received from an agent representing the ship’s insurer.
According to the communication:
- Two persons had reportedly been rescued.
- They were believed to be under the custody of Romanian authorities.
However, these facts had not yet been officially verified by the concerned port or coastal authorities.
Justice Bagchi therefore observed that clarity from the Government of India was essential before drawing any conclusions.
Supreme Court’s Directions
Recognizing the urgency of the situation, the Supreme Court issued notice in the petition and passed several important directions.
- Immediate Diplomatic Action –
The Court directed the Ministry of External Affairs to immediately employ diplomatic channels to determine the whereabouts of Deepak Kumar Gupta.
This includes:
- Coordination with Indian embassies,
- Communication with Romanian authorities,
- Engagement with Ukrainian authorities,
- Liaison with relevant international agencies wherever required.
- Instructions from Indian Embassies –
The Solicitor General was directed to urgently obtain instructions from:
- Indian Embassy in Ukraine, and
- Indian Embassy in Romania,
regarding the status and location of the missing Indian seafarers.
- Compliance with International Maritime Standards –
An important aspect of the order is the Court’s direction requiring the Union Government to clarify the applicability and compliance with the International Maritime Organization (IMO) framework relating to the fair treatment and protection of seafarers. The IMO, together with the International Labour Organization (ILO), has developed guidelines to ensure that seafarers involved in maritime incidents receive due process, consular assistance, medical care, repatriation, and coordinated support from flag States, port States, and their home countries.
