Consent to operate
Acquiring consent to operate necessitates engagement with the Pollution Control Board of the specific state. This imperative is relevant not only during the pre-commissioning stage but also throughout the operational lifecycle. The consent, while initially secured, remains subject to periodic renewal to ensure ongoing compliance with environmental regulations.
Building Completion certificate
The Completion Certificate (“CC”) is a crucial legal document that builders must obtain through an application process to relevant authorities like Town and Country Planning, Local Municipality, Development Authority, Agricultural Department, or other local entities such as Nagar Nigam or Gram Panchayat.
This application involves submitting plans, scrutiny fees, and proof of land allotment. After the project is completed, the local governing body conducts a thorough inspection of the property in comparison to the approved building plan. Once all regulations are met, the Completion Certificate is issued as confirmation of compliance with established norms.
Final Fire Approval
The ultimate fire approval must be procured from the relevant state-level authority.
Water Connection
Approval for water connections necessitates engagement with State Industrial Development Corporations. In cases where the water source is a river, canal, or dam, the requisite approvals are sought from State Industrial Promotion Boards, where applicable. Additionally, for groundwater extraction, approval is sought from the Central Ground Water Commission.
Power-
Submission of an application to the State Electricity Distribution Company is essential to securing authorization for power supply. This pertains to a range of connections, including low-tension, high-tension, or Extra tension, as per the specific requirements.
Authorization for hazardous waste
Submission of an application to the State Pollution Control Boards is necessary when seeking permission for the management of hazardous waste, which encompasses activities such as collection, reception, treatment, transport, storage, and disposal.
Professional Tax Registration
Pursuant to Section 5 of the Profession Tax Act, all employers (excluding government officials) are accountable for tax payment and must acquire a registration certificate from the designated authority.
The company is mandated to apply using Form I to the appropriate registering authority.
Central Excise Registration
The submission of the registration application is directed towards the Superintendent of Central Excise, who holds authority over the premises for which registration is sought.
Please note: The scope of Excise pertains specifically to units dealing with liquor and petroleum-based products.
Shops and Establishment Act
The registration under the Shop & Establishment Act is administered by the state government.
Employee Registration with Employees’ State Insurance Corporation (“ESIC”)
The ESIC offers financial and medical benefits to employees in situations of illness, maternity, and employment-related injuries, along with provisions for associated concerns. Employers are required to utilize Form 01 for registering with ESIC.
Employer Registration with EPFO
The Employees’ Provident Fund Organization (“EPFO”) extends social security benefits to employees working in establishments governed by the Employees’ Provident Fund and Miscellaneous Provisions Act, 1952.
Trademark/ Brand Registration
Trademark registration grants the owner exclusive legal rights to utilize the mark, ensuring its distinctive use. The process of trademark registration encompasses several sequential stages.
Importer Exporter Code (“IEC”)
The Import Export (“IE”) Code stands as a prerequisite for individuals engaged in the import or export of goods and services from India. The issuance of the IE Code falls under the jurisdiction of the Directorate General of Foreign Trade (“DGFT”), an arm of the Ministry of Commerce and Industries, Government of India.
Once obtained, the IE Code remains valid for the entirety of the entity’s existence and does not demand periodic renewal or submissions. The application for an IE Code must be submitted to the Directorate General of Foreign Trade, accompanied by the requisite supporting documentation.
Customs- Special Valuation Branch
The Special Valuation Branch (“SVB”) serves as a division within the Custom House with a dedicated focus on scrutinizing transactions that pertain to the association between the supplier and the importer.
Grant for Bureau of Indian Standards (“BIS”) License
To initiate the process for obtaining a license under the Product Certification Scheme of BIS, the applicant is required to furnish the application in the designated format, along with a Self Evaluation-cum-Verification verification report, accompanied by the stipulated documents and the authentic original Test Reports.
Quality Marking Certificate
Certificates for Quality Marking are issued by the Quality Marking Center under the administration of the State Government.
