The Supreme Court ruled that the Plaintiff lacked ownership of the property herself, therefore cannot grant such rights through a lease deed. Even with a seemingly legitimate document, the son’s claim failed. The Supreme Court laid down two key principles:
- If someone tries to transfer property rights without actually owning them, the recipient (and their successors) cannot enforce those rights based on that document.In simpler terms, an individual cannot give away what they don’t legally own. This applies to any attempt to transfer property rights and not just lease deeds.
- If a deed clearly shows the transferor has no title, a separate court declaration of its invalidity is not necessary. The court can invalidate the deed itself if it’s evident on the face of the document that the transferor lacked ownership.
